The tour operator's right to cancel the trip

The tour operator has a right to cancel the trip,

  • if authorities recommend avoiding travel to the said area. However, to protect the traveller's health the tour operator can use his/her right to cancel more extensively than recommended,
  • if the possibility to bring about the trip in the agreed manner has become substantially more difficult due to a natural catastrophe at or near the destination.

The tour operator must inform the traveller about the cancellation as soon as possible.

  • The tour operator must return all payments paid by the travellers without delay.
  • The tour operator is not obliged to pay the traveller any possible costs or other damages caused by the cancellation, if the trip is cancelled due to a situation deemed to be Force Majeure.

The traveller may demand a new, similar trip at the price which he paid for the original package, if this would not occasion unreasonable costs or inconvenience to the tour operator. If the price of the substitute trip is lower than the price of the original trip, or if it does not comprise the services which were originally agreed, the price difference or that part of the price which corresponds to the services which are not included must be returned to the traveller.

  • A similar trip is deemed to be a trip which has the same minimum standards and value than the cancelled trip.
  • The trip does not have to be to the same destination or even to the same country.
