Sales and marketing targeted at children are under particular supervision by the Finnish Consumer Ombudsman. In the current issue of our online magazine focusing on the theme of children, we discuss cases where direct invitations to purchase have been targeted at children thus circumventing the possibility of parents to properly exercise parental guidance relative to their child.

An addressed direct marketing letter was sent to children turning 10 by a bank. In the letter, the children were welcomed to a branch office of the bank to obtain a personal Visa Electron card to mark their 10th birthday. The marketing circumvented the parents’ right to exercise parental guidance relative to their child by unlawfully appealing to the child directly and failed to indicate the rights, obligations and responsibilities associated with the use of the payment card.

Companies must make sure that their marketing complies with the provisions of the Consumer Protection Act and that no direct invitations to purchase are targeted at children for example via direct marketing letters.

As concerns loyalty programmes aimed at children, particular attention must be paid to the way in which the child joins the programme and the type of direct marketing that is targeted at the child. Prior consent of parents is required both for a child to become a member of a loyalty programme and for direct marketing targeted at children.
