Giveaways promised in conjunction with a purchase are not free in the sense that the consumer must buy a product or service to get them. The value of the giveaway must be disclosed in the advertisement if it's over 10 euros and the price indicated must be the actual price of the item. The main message in advertising must be the product being sold. An advert that is clearly dominated by the giveaway rather than the product itself is prohibited by law.
The Consumer Protection Act provisions on defects also apply to giveaways. The consumer may claim compensation from the business even if the giveaway represents a product group that is not in the seller's regular product range.
If the advertised giveaway is not provided within the time period mentioned, the customer has the right to demand it from the business. The customer does not need to accept an alternative product instead of the advertised giveaway.
